not repairing a contract cellphone

I had a contract at nashua mobile,the device had a problem and needed to be repaired,after 3 weeks of waiting the claimed the phone couldn't be repaired and they were closing down and the contract was moved to mtn.I took the phone to mtn for them to repair it seeing that mtn was debting my account,mtn took the phone for repairs and told me that if the phone can't be repaired I must pay R336 and now I got a bill from mtn repair centre that I have a quote to fix a contract cell for R3365.how can I pay the when a device has a warrenty and why should I pay any fees to get the phone repaired if its a contract

Thank you for your post.

Service charges shall be applicable to all out of warranty and non-warranty devices (meaning the warranty has been voided or has expired).

These charges are applicable when the Customer has instructed MTN to assess the Device, which by necessity requires certain services to be performed by MTN for the purposes of assessing the fault/damage in order to validate warranty or provide you with a quotation for the costs of repairs to the device.

The amount is charged only when a Device is not covered by the Original Manufacturer's Warranty, and or/the Workmanship Warranty either because the Warranty has expired or the fault/ damage is not included as a part of such Warranty.
