No Cooling off period

On 31 March I went into the MTN branch in Kolonnade mall. I took out a new use your own device\contract as I already had a handset that I was using. The contract was taken out successfully.<br> <br> 3 days later my own handset broke. I went into the same MTN shop on the 5th of February and asked them if I can change (increase) the contract so that I can get a handset. The sales consultant said I had to phone 808 and confirm with them if I can change it.<br> <br> on 6 Fabruary I phone 808 and spoke to someone in the sales department. he confirmed that the contract can be changed within the first 10 day. (unfortunately he did not give me a ref nr) on the same day I went vback to the MTN shop and asked them to change the contract.<br> <br> They said that the contract cannot be changed as there is no cooling off period. (According to law there has to be a cooling off period in every contract) <br> <br> I then asked if I can cancel the contract and they said a penalty fee op R 869 will be payable.<br> <br> I only had the contract for 6 days and feel like that penalty fee is ridiculous. Each contract should have a cooling off period and I should be able to cancel the contract 6 days after it was taken. <br> "

Thank you for bringing this to our attention.

I am terribly sorry for the inconveniences experienced as a result this. I completely understand the frustration it causes. Kindly note that the cooling off period only applies when a contract was done virtually and not at a point of sale as per the CPA.
