MTN wrongful listing on Credit bureaus
During Covid time Peter Marais's (Id nr. *** ) data contract expired. As he couldn't go into MTN's offices it was duly cancelled by Email. After MTN still deducted the monthly fee by way of debit order. We have lodged a complaint at MTN and on the 15th of September 2022 we received the following letter from MTN's customer care signed by Carmen Wentzel which reads as follow: " Thank you for your email. Please accept our applogies for the delayed response and any inconvenience occurred. Kindly be advised that the contract was cancelled and the number is on prepaid." At the end of September 2022 MTN once again deducted R2130.00 by way of debit order, which was reversed. Once again a letter was sent to MTN confirming that we have reversed the debit order, without any response from MTN. About two years later, our client purchased a house and it came to his attention that his name was put on the credit bureau for the reversed debit order. He once again lodge a complaint and his name was removed from all the credit bureaus and he purchased the property. Now about another two years later he wants to buy a second property, he was informed by the bank that his name is still on the credit bureau Experian as a default payer for the debit order that has been reversed by our client. On the 04th of September 2024 a letter was once again sent to MTN demanding that his name should be cleared at all credit bureaus before the 09th of September 2024. As in the past, MTN did not have the decency to either remove Peter Marais's name from the credit bureaus nor have the decency to respond to any of our letters. The only way to clear his name is to get a declatory order at the High Court to remove his name, which seeing in the light of high cost in the High Court it is absolutely ridiculous. The other option to clear his name is to pay the R2042.00 which is totally towards him. Can you please assist to clear his name. A complaint was forwarded to the ombudsman but they could not assist and say that he must sort it out with MTN and the credit bureaus. I have proof of all correspondence to and from MTN.
