MTN SOUTH AFRICA BREACH OF CONTRACT!!
Beginning of September I entered into a data contract with MTN South Africa. It was a promotion they had running on that month where they offer 40GB day-time and 40GB night-time data. I entered into 2 of these contracts at the same time. One sim only and the other with the sim card and router. On the first of each month a debit order goes through for both the contracts and I have fulfilled my duty, as per the contract, of paying the agreed amount, IN FULL, on the stipulated date. The sim and router contract has been fine, I have been receiving the correct amount of data since the contract was signed. On the sim only contract I have not been receiving the correct amount of data, right from the beginning. I have been receiving 20GB day-time and 20GB night-time data, which is incorrect according to the signed contract. I contacted the individual who assisted me at the store and he did a check to find that, yes I am supposed to be receiving 40GB day and 40GB night data, it has been stipulated on the contract also. He then informed me that the information which he entered into the system was correct but down the line to the department which allocates the data or actions th contracts, he discovered they had entered the wrong dealer code or something like that which resulted in a processing error. They instead entered the dealer number for a 20GB day and 20GB night time bundle. He has really really been trying to assist me by escalating the matter numerous times. He even sent the MTN brochure and the signed contract as supporting documents so I could be given the correct data, but the incompetence persisted. I discovered that I had been receiving the incorrect amount of data middle of October because of the rate in which it finished and it has been over a month, trying to resolve this issue but nothing is happening. I have been paying the full amount each month but receiving the incorrect amount of data. This is a breach of contract on the part of MTN and this also amounts to unjustified enrichment. I have also suffered a patrimonial loss. I am currently owed 60GB day and 60GB night time data by MTN for the months of September October and November. At this point I seek not only to be compensated my correct data, I also seek to be compensated for the the trouble i have had to go through and the patrimonial losses suffered. I have also had to buy more data for my cellphone because the data which I pay for every month is not the agreed amount and it finishes at a very fast rate. So I therefore have had to incur MORE costs than I should because of the incompetence on MTN South Africa.
Should this matter not be resolved within the next 48 hrs, I will be left with no choice but to take legal action against MTN South Africa. I have been patient long enough.
