MTN not wanting to refund Huawei Y7P

We have bought the Huawei Y7P device from MTN Tambotie Mall Randfontein and (returned within 1 day) with clear indication to the sales person: for the following primary uses: 1) Photography to post videos and photo’s online 2) Playing games specified Fortnite 3) Download videos from YouTube and view later

We returned it a day later : •The phone cannot play Fortnite, FIFA20, Minecraft. •YOUTUBE videos cannot be downloaded and viewed offline later •Adobe Photoshop, Polish, Lumil and other photo editing Apps used are not available •Voice Command don’t work on the Internet search engine mainly used for school research

We were told that the phone cannot be refunded or exchanged as a SIM card was inserted in the phone- which by the way was an old SIM we have as no Starter pack was even supp**** by MTN upon sale, so how was the phone RICA'ed? and tested by trying to download the games or Apps we want to use,

We feel it was sold under wrong pretenses with the shop’s knowledge that it will not suffice, now MTN does not want to refund. Even if they did not know that these services might not be available, surely the Consumer Protection Act allows for returns- nowhere on the invoice it states any terms, we recall the lady stating that if we have any issues we can return it in 7 days.
