MTN Newcastle - Breach Of Contract
<p>Good morning,</p> <p> </p> <p>I trust you are well. I Kirana Maharaj ID Number 930 ********** 089 have taken out a contract with MTN Last year September where the contract came with the Samsung Galaxy S6 Edge. On the 13th of December within the 3month warranty I have taken my Samsung Galaxy S6 Edge back to MTN Newcastle due to the fact that it was over heating and not charging.</p> <p>They have sent the device for a warranty assessment. Yesterday when I called head office to follow up on the repairs, my device could not be traced on their system until I called back with the IMEI Number .Today I get a call from MTN Newcastle stating that the warranty assessor has confirmed that my phone needs to be replaced. MTN Newcastle did explain to me that the Samsung Galaxy S6 Edge has been discontinued therefore they cannot replace my phone with the exact same phone. I was told that I have to choose between the Samsung A7, Huawei P9, Sony XZ or Huawei Mate 9. Nozipho has confirmed that these phones are lower in value compared to the Samsung Galaxy S6 Edge and if I choose one of these phones even though it is lower in value my monthly installment will remain the same. I did mention to her that I am considering taking the Samsung Galaxy S7 Edge but was told if I want that phone I will have to pay in R3000.</p> <p> </p> <p>My complaint is I did not break or damage the device! I was given a faulty device and I honestly feel that I should not downgrade or take a cheaper phone just because they do not make that device any longer. It is either I take a cheaper phone and my monthly installment decreases or my phone will have to be replaced with the exact same phone or a better phone at no cost to me.</p> <p> </p> <p>Feedback regarding this would be highly appreciated.</p> <p> </p> <p>Kind Regards</p> <p>Kirana Maharaj</p>
