MTN negligent and not complying with NCA

MTN not complying with the NCA and dragging my creditworthiness in the mud.

I had a contract with MTN for 10 G / month. It was a two years contract. I would have the data bundles depleting without me even downloading anything. I called their call centre and requested for the contract to be cancelled but it was not cancelled which l only learned two weeks ago. How l had to learn about this was when l had my credit application failing and was informed that l had an adverse listing by MTN. I went back to the MTN shop only to be told the account had been handed over to their MTN legal department. I called them and they said that the account had been handed over to Saya recoveries. I asked for the Saya recoveries contacts. I was told how much l owed by the Saya Recoveries including the penalty fee for cancellation. I paid the amount in full for both arrears and cancellation fee. I send the proof to MTN and the next thing, their credit control sends me an email acknowledging the payment and informing me that the line has been reactived. I responded and informed them that l wanted cancellation of the contract not reactivation. Noone responses to my queries all l get is one transfer from one person to another. I am so agrieved by the manner at which they just submitted my name for adverse listing and yet noone from their company was ever in touch to query why the account was in arrears. I need the name of the Ombudsman or commission which deals with this injustice to debtors. How l got listed adversely without even a single call or email to say that is the route that we are taking. I was under the impression that the contract was cancelled in June when l asked them to do the cancellation.

I have basically been send from pillar to post. I have had to pay a lot of airtime to talk to people in legal and the recoveries people. How could l not have afforded a less than R300 instalment per month when l could afford to spend money on data bundles every month got more than that on my prepaid line with the very same MTN. This line which l am also planning to discard and go back to Vodacom which l had ditched for their very exhorbitant charges. At least Vodacom was giving me value for my money not this nightmare that l have got from MTN.

Thanks Jessica. The assistance that l need right now is that of making sure that my name is removed from the adverse listing that MTN instituted without following due care and the National Credit Act procedures. If that can be done maybe we can still salvage this business relationship.

Thanks Jessica. If l had known that this platform is the most efficient in getting heard l could have saved my time and money spent on trying to get MTN shop consultants and call centre personnel to sort out my query.
