MTN IS A LIE!!

To avoid typing over and over, I'm copying my communication with Legal here.

The long and short: A few months ago, your legal dept handed me over to Saya Recoveries for collections as I had "supposedly" went into arrears.

1.Now my problem is that, for duration I've had the contract with MTN I stopped receiving statements on balances outstanding in 2017/18, but was under the understanding that the money was still being debited as that was the instruction given to MTN. Fast forward to 2019, I renew the contract and again I'm told by the clerk who renewed the contract that I have no outstanding balance on the account... I set up a debit order again with MTN for the amount of R295.00, months go by and I still don't receive statements of the account. All of a sudeen out of the blue, in comes Saya Recoveries to tell me that I've been handed over, I eventually agree because I don't my credit score to suffer. Now please explain to me how it's my repsonsiblity to ensure that a debit order confirmed by MTN is my responsibility? Explain to me why I've not received one statement in over two years from MTN? but I'm expected to pay a debt collection agency for neglegence on MTN's side?

2. Here's a brief breakdown...

Contract was opened in 2016/17 and had been paid every month in that period... 2018 I got ****** and the phone had been ******, I informed MTN of this and requested a sim swap which was never done I requested this be done multiple times... I end up going to your branch to see if I qualify for new phone, it so happens that I do. I ask the sales the rep if there's anything outstanding on the account, she confirms that there's no outstanding balance on the account. I receive the phone, we sign the contract. Where I confirmed my current number as my primary number and requested that the number *** be ported to my current number ***). I nominate my capitec account (...)6668 as payment account for debit orders on the dates: 31/1/7/15 (speaking on correction will forward contract for confirmation).

Not once was it communicated that I missed a debit order/payment. I used to receive both emails and sms's when I did fail to pay in 2017. This is complete neglegence on MTN side, and now I must pay the price? It is affecting my credit score negatively, and putting me at a bigger financial loss. I cannot accept this, as I did my part. Again I say:

I nominated my capitec account as debit order account (...6668) I nominated my current cellphone number as primary contact ***)

MTN did not make due means for any of this to be done, this whole mess is a mtn fault. How can I be held liable for your own neglegence? I have everything in black and white, in form of a copy of the contract.

Please contact me on my cell today if possible ***, alternatively respond on this email. This whole situation caused by MTN neglegence is leaving me in the red every month... This needs to be resolved asap, and I don't see why I must be the one to be paying for MTN's neglegent behaviour.

3. All your legal agent keeps doing is tell me about outstanding amounts, it's like he does not read my mails with understanding.

3.1 Your sales agent day of receiving the device tells me my account is in good standing 3.2 On contract renewal I provide my contact details for communications, and bank account for debit orders 4. None of the contract agreements were met by MTN, how do you give me a new mobile if my account is in "areas"

So now tell me what must I do, how can you honestly expect me to pay what you've told me pay? when you've not captured details for communications on statements and account stadning? this is utter neglegence on your end MTN and it's the cause of my credit score being in sufferage. You're legal dept takes days to respond to a single email.
