MTN ******* activity according to CPA law of South Africa and their own contract

STILL, NO REPLY FROM AN EMAIL SENT ON THE 10TH OF JUNE. STILL, NO REPLY TO A CANCELLATION REQUESTED ON THE 2ND OF JUNE.

Today is the 5th, 6th, 7th, 8th, 9th, 10th, 11th, 12th, 13th, 14th, 15th, 16th, 17th, 18th, 19th, 20th, 21st, 22nd, 23rd, 24th, 25th, 26th, 27th 28th of June as still the contract has not been cancelled for either device and still, I have no sim card and am unable to make or receive calls.

How many times will I have to send this email and add today’s date?

To whom it may concern. I would like to bring to your attention the ******* activity and poor service of Gateway MTN store 1395, store managers Thevashen Govender and Ishan Beesandi as well as consultant Nompumelelo Shozi. On the 29th of May 2021, I went into this MTN store and successfully took out a cellphone (Samsung Galaxy S20FE) contract as well as a smar****ch (Samsung Galaxy Active 2) contract. I also paid R150 .00 to have my cellphone number ported to the contracted SIM card, whilst in store. On the 2nd of June 2021 – I went into this store to return both the cellphone and smar****ch, with all the packaging, and request the contracts be cancelled. (Please see Store Acknowledgment letter attacked – this was all I was given when I requested proof of me handing over the devices and requesting the cancellation.) The consultant in the store took everything from me, including the Simcard and, informed me that I cannot cancel the contract until the store receives an RMA number from their JHB repair centre which will be sent to the store after the cell phone has undergone a warranty assessment by HRVC. I then went home to phone the MTN Customer Careline who assured me that this was not the procedure the store was meant to follow and that instead, the store should have cancelled the contract immediately as I returned the devices and all within 3 days. (Please refer to my Request for Cancellation e-mail to the store, attached.) I made several calls to MTN Customer Care and have reference numbers of calls where consultants have advised me that the store is not following the correct procedure. One of the MTN Client Care consultants even suggested I go to the Ombudsman and should not leave until the store cancels the two contracts. Here are some of the reference numbers: *** – 10th June *** – 10th of June *** – 8th of June *** – 8th of June *** 7th of June I even made calls to the MTN Customer Care centre whilst in-store where two of the MTN Customer Care consultants urged both @nompumelelo Shozi [ MTN SA - MTN SP ] and the manager on duty @*** @*** to cancel the contracts immediately. Still, the store refused to assist. I physically went back to the store, for a third time, on the 8th of June where @nompumelelo Shozi [ MTN SA - MTN SP ] and @*** @*** **** to my face, informing me that the phone was collected by HRVC days ago and that they were just waiting for the RMA number before they could cancel the contract. HRVC confirmed that they only collected the device on the 8th of June and that their reference numbers would not assist in the cancellation of any contracts. So, what exactly was the store doing with the phone and watch from the 2nd of June to the 8th of June? HRVC repairs also informed me that the store booked the cell phone in for a warranty assessment which would take up to two weeks. Their reference number is IMEI ***. This is only one reference number – does it include the smar****ch @nompumelelo Shozi [ MTN SA - MTN SP ]? And if not, where exactly is the smar****ch? Today is the 5th, 6th, 7th, 8th, 9th, 10th, 11th, 12th, 13th, 14th, 15th, 16th, 17th, 18th, 19th, 20th, 21st, 22nd, 23rd, 24th, 25th, 26th, 27th 28th of June as still the contract has not been cancelled for either device and still, I have no sim card and am unable to make or receive calls. The return of goods claws under the Consumer Protection Act in South Africa clearly proves that I am well within my rights to cancel these contracts and this store is clearly operating outside of the law. Please would someone offer me some sort of assistance in cancelling this contract? Thank you in advance and I look forward to a resolution for my contracts and a resolution for the despicable behaviour of this MTN store and the staff.
