I'll try and summarize the matter.
I have an issue with MTN, an 'upgrade' was done on my MTN account in 2017 without my consent.
I realized this when I was getting billed for 2 subscriptions, I called MTN and was told I have another subscription which "I have signed up for" upon disputing this, the following documents were requested: affidavit from the police station (stating that I didn't signup for the upgrade), a certified copy of my ID,3 signature specimen. All these documents were sent and received by MTN.
After a couple of months I received a call from VVM after MTN listed my name. After explaining to VVM what had happened, the same above mentioned documents were requested again. Which were sent to VVM.
Upon VVM's investigation, the matter was handed back to MTN.
I then contacted MTN's Legal department, where they told me that the case has been pended.
After numerous attempts, to get feedback. On the 16 Jan 2020, I received an email from MTN's Legal department that confirmed the subscription to be ********** and a "notification was sent" to the credit bureau to action payment profile removal.
On the 15 Feb 2020 I received a call from VVM stating that my name has been handed to them by MTN for payment collection, I explained the situation again and was requested to send through the same documents which I have sent before.
I requested to escalate the matter to a supervisor, I was then referred to Rose Fourie.
I spoke to Rose and explained to her the matter from scatch, she then requested I send her all the communication I have with MTN and VVM, which I did and also resent the above-mentioned documents for the 3rd time.
I sent Rose emails requesting feedback after 21 days with no response. I then turned to their What'sApp chat and the consultant told me that the are awaiting a letter from MTN confirming the subscription was **********.
I sent a screenshot of the email (which was sent to Rose VVM) on the chat and the consultant didn't have any answers.
As I write this I just received an email from VVM regarding my outstanding account
What legal steps can I take against MTN for exposing my details/account to ********* and therefore putting me in this position in the first place. Also this matter has had a very negative impact in my life and family in terms of being unable to get a home loan or a better job due to a bad credit score.
Your advice will be highly appreciated.
