MTN DISREGARDS LEGAL PRINCIPLE -BLACKLISTS INNOCENT PARTIES

MTN has had me blacklisted because of a ********** contract.

In what seems to be a case of identity theft someone apparently entered into a cellphone contract with MTN using my identity **********ly. Debit orders were submitted to FNB. FNB alerted me to this suspicious debit order and helped me stop it. However, while FNB noticed that something was amiss MTN continued pursuing me.

I was contacted by persons in the most unprofessional manner imaginable- so much so that I suspected it was the ********** themselves. I consistently denied that I entered into any such cell phone contract with MTN. Never was I presented with any evidence that the contract existed or any evidence that I indeed entered into such a contract or any detail such as where, when or given a chance to inspect any signatures, etc. The existence of this contract was never proven-unsurprising because no valid contract exists.

Eventually, I was contacted by attorneys demanding payment. Again I made it clear that I don't have any contract with MTN. I sent them the required affidavit, copies of my ID and examples of my signature as required. Much to my surprise, without any further communication, I have now learnt that I have been blacklisted by MTN.

How, can a company such as MTN simply have individuals blacklisted without ever proving that the alleged contract existed. It is a well established legal principle that "he who alleges must prove" and that in a country where identity theft is commonplace. This is a total disregard for legal principle and innocent until proven guilty.
