MTN
I have a contract with MTN for a Samsung Note 10 (nr. ***) that I bought for my daughter and I agreed in a written contract that the amount of R449.00 will be subtracted by debit order from my Nedbank Current Account at the end of each month.
In December 2021/January 2022 a parcel was delivered via a courier from MTN to the farm where I reside. When I opened the parcel I received a cell phone and a lap top computer from MTN which I did NOT order. NOBODY ever phoned me in advance to discuss if I was interested in this offer! A week or two later another delivery was made from MTN which I refused.
On 31 January 2022 an unauthorised debit order for the amount of R 2017.68 was made by MTN from my Nedbank account for the unauthorised cell phone and laptop. I reversed the debit order on which MTN in return blocked my daughter’s phone and she could not make phone calls which resulted that she could not enter the complex where she lives as she needs to phone the main gate to open it. We went to MTN Lephalale to return the devices, who informed me they are not permitted to receive these devices and I had to pay them an substantial amount to unblock her phone.
I phoned MTN to resolve this issue, arranged with MTN to come and collect the cell phone and laptop for both devices are still in its original packaging and not used by us! MTN never made the collection!
On 4 July 2022 the phone was once again blocked by MTN, an unauthorised amount of R1407 was deducted from my bank account reason we are not paying the cell phone and laptop, AGAIN we arranged with MTN to come and collect the devices still in the original packaging, AGAIN MTN failed to collect.
On 1 August 2022 an unauthorised amount of R 6542.20 was deducted wich we reversed.
We talked to MTN numerous times via email and via phone calls regarding this issue, asked for proof that we ordered these devices, still their legal department informed me that they investigated the matter and we need to pay these devices, but still they failed to sent us any proof of consent from our side ordering these devices?
MTN now called me and informed me that I owe them R35 000. From 28 October 2022 the phone is once again blocked, as well as blacklisted by MTN and I would like to end this contract and move to a different service provider as the contract exspires before the end of the year. With the phone being black listed I am not able to move to a different service provider! My daughter now has to borrow her work phone to open the gate to the complex where she resides. How do I resolve this issue?
