MTN CONTRACT OF DESEASED - A LANGHOFF -

On 12 July 2016 Mrs A Langhoff, ID number 621 ********** 085, Cell 082 ********** signed a 24 month contract with MTN network. Mrs Langhoff passed on 26 June 2017. On 4 Juy 2017 I visited MTN Cape Gate and consulted with Christopher – my request was to change the banking details as the current bank account will be closed by the Executor to process the Estate. I was informed I can’t change the banking details unless Mrs Langhoff is present – well that was rather impossible. I informed Cristopher that Mrs Langhoff has passed and I would like to keep the contract and the number as it has been my parents number since I can remember. Christopher advised me that the contract can be cancelled since Mrs Langhoff has passed. I inquired whether there will be a lump sum settlement as I would rather continue paying the contract if that is the case. Christopher confirmed that there will be no lump sum settlement and the final payment will be due at end July 2017 in the amount of R249.00. He will keep me posted regarding the progress of the migration and cancellation. To my surprise I received a sms from MTN on 28 July 2017 that a settlement amount of R2 555.97 is due for the cancellation of the contract. I contacted Christopher on 29 July 2017 on 083 ********** and informed him of the lump sum settlement request. I reminded him of our conversation on 4 July 2017 that I choose to continue with the contract in the event of a lump sum settlement. He rep**** that he confirmed with his Supervisor and the contract is less than a year old therefore the settlement I due. He was unaware and uninformed in this regard as he has cancelled contracts before and none of the client received a lump sum settlement request. However he is covered as my mother (Mrs Langhoff) signed the contract. First my initial request to change the banking details to continue the contract was denied. Then I was mislead with false information to sign the migration papers.

I will continue to pay the contract until it expires and will then cancel the contract. I refuse to pay the lump sum settlement as this was definitely not my request. I read through the contract and nowhere does it cover in the event of death that the contract must be cancelled. I am the legal beneficiary of Mrs Langhoff’s estate.
