MTN acting against the POPI act

Visited the MTN walk-in store in Menlyn, Pretoria, to renew my contract. Went through the whole process, only to be given a contract in which I am forced to give MTN permission for all their spammy marketing tactics. Nobody in the store could get the system to print a contract in which the spam boxes are unchecked. Not being able to say "no" to spam in the first place is not a legitimate form of permission or consent and is against the POPI act. How can you "opt out" of spam if you never opted in for it in the first place?
