******* use of direct marketing

Since 21/02/17, I have received daily SMS messages from MTNData stating that I am using data at out-of-bundle rates, and offering a 'Special offer just for you!' However, after checking my data balance repeatedly after receiving the SMSes, I discovered that I had plenty of data. Also, at many of those times, I was using WiFi, which means no cellular data usage.

Please explain what gives you the right to communicate false and misleading information to your customers, with the intention of panicking them into buying data that they don't actually need? I believe this contravenes consumer protection and direct marketing laws, and is thus *******.

In addition, the SMSes do not provide an opt-out option, which is also ******* according to the Consumer Protection Act.

I await your response before I take this further to the Consumer Goods & Services Ombud.
