I was Given a wrong Phone by Insurer

<p>To whom it may concern/ MTN Insurance</p> <p>Ref No: [MTNLF ********** ]</p> <p>On October 2016, I bought a Huawei P9 at the MTN store in Pavilion, Durban. I also took the appropriate insurance for the phone.</p> <p>On July 2017, I unfortunately encountered an accident and the phone was ******. I followed procedure and reported the accident at the nearest police station. I got a case number and forwarded all details to the MTN Insurance department.</p> <p>They swiftly processed my case and sent me a replacement phone, however when the phone was delivered to me at work. Later I discovered that they had sent me a Huawei P9 lite instead of a Hauwei P9.</p> <p>I contacted the MTN Insurance department to report this to the manager and he simply concluded by saying, he will not be able to give me a Hauwei P9 as the phone they gave me was used. There was a sticker on top of the box that hindered my ability to see writing on the box. I then called and told them, they delivered a wrong phone and the case was cascaded to their manager. Unfornately, they forced me to take Huawei P9 lite which I refused to do. </p> <p>The Consumer Rights Act makes it an imp**** term of the contract that goods be as DESCRIBED, fit for purpose and of satisfactory quality.</p> <p>As you are in breach of contract I am still rejecting the incorrect replacement item and request that you collect it and bring the correct item that I had insured for.</p> <p>I require your confirmation whether you will arrange for the incorrect replacement to be collected.</p> <p>Many Thanks,</p>
