********** purchases assigned incorrectly to client's account after *******ly limiting the client's rights within the South African Consumer Act & South African National Credit Act
I am extremely hurt and aggrieved!
I have been a loyal customer of MTN for over 25 years and have never missed a payment or been late of my total bill levied by MTN. It is in the region of R3,500 a month almost the price of my car.
I would really like someone with authority to contact me regarding R14,000 worth of ********** purchases made on my line.
I was ****** while on the phone in the Cresta parking lot. Obviously the phone was unlocked while I was talking and the ******* proceeded to make the ********** purchases. I managed to interrupt their process by doing a sim swop. I didn't use any of the purchased services at all.
I contacted my MTN store the next day when I noticed all the data and call time which they didn't help with. I then approached customer care at MTN on 083135 and they told me they couldn't see it on the system. I have made several calls since December and reported the ***** at SAPS. I handed the sworn affidavit at MTN head office 14th Ave, Fairlands. MTN now insists that I have to pay for the ********** transactions, where they could have reversed it, if their system wasn't so ineffective.
I unfortunately can't afford to pay, thus my perfect credit score is going to hit adversely and furthermore, I will be forced to get legal assistance regarding this as I can't believe the South African Consumer's Act and ICASA allows this kind of bullying from MTN and allows them to limit my rights as a consumer to this extent where they can assign any cost they please.
Please refer to the South African Consumer Act and South African Credit Act for clarity of what rights are awarded to the consumer / lender.
There was absolutely no consent made to allow these ********** purchases which makes them null and void.
