*****ulant Contract sale

An MTN telephone Sales person phoned us on the 24/04/2018 to upgrade/renew the Data contract. The contract was for 3GB of data per month which expired 30/04/2018. The sales person said that all the documents will be mailed with the replacement Sim Card. About 3 days later we only received the Sim Card but no documents stating changes or detailing of the new contract. The new contract was for 6GB+6GB(Night Data) for R139/month. At the end of the month we received a statement R509.83 after the Sale Person told us that the amount will never exceed R139. All attempts to speak to MTN at branch level failed as they dont accept responsibility for 3rd Party MTN Franchise sales. We were refered to the following number by the MTN sales person at the branch ********** . We phoned this number and just get an automated answering machine stating they are experiencing high call volumes and that someone will take our call shortly. After 2-4 minutes with out fail the line disconnects. It does not matter how many times you phone this number nobody picks up your phone call and it just diconnects. Now 2 things that make this contract Null and Void the 1st, is the failure to deliver the official documentation with the sim card. It is my right as a customer to have these documents for 1 legal purposes and 2 disputes as provided for in the Customer Protection Act in MTN's Fineprint. The second thing that makes this contract Null and void is that the phonecall was recorded, and theirby as part of the compliance of the contract to make the contract binding it needs to match up with the details of the contract upgrade/renewal, which it does not. So if this goes unheard and no response or action is taken, my next step will be the ombudsman and then failing that legal action. To finish off, MTN need to take responsibility for its franchisee's actions. Even Cash Convertors have a retension program to make sure their Franchisee's follow the Terms and Conditions of the company to the T, failing that the Franchisor can revoke the Franshisee permit and forfeit it from further trading actions with the public
