***** AND POOR SERVICE DELIVERY

I upgraded to a contract in October 2016 through CCI but what I agreed to was not delivered so I requested cancellation of the contract from 29 November due to *****. CCI dragged their heels and did not respond to any of my queries straight through to 27 January 2017 when the I finally received confirmation that the cancellation was processed. With that final correspondence I was told by CCI that if MTN deducts the outstanding amount on my account (which was based on a ********** contract which they admitted to) they would refund my money. I am in the process of getting the refund from CCI currently.

Then on 12 February 2017, my phone was awarded with airtime again as per the agreement with CCI which according to me was cancelled and which I have proof of in the form of an email from MTN.

I contacted MTN and was told that the cancellation was not done and they only have record that the upgrade was cancelled and not the contract and that I am liable to pay the account of R76.00. However, the mail received did not specify this so I refuse to pay this account and I have been in correspondence in regard to this since 22 February 2017. I also received confirmation on 22 January 2017 that my contract was cancelled (according to me for the 2nd time) and that I was now on Pay-as-you-go.

On 1 March 2017, the amount of R76.00 was deducted from my account without my permission as according to the mail received from MTN on 27 January 2017 and all correspondence since 22 February 2017 state that I had no further obligation towards MTN as I have proof of cancellation. This case is also now at the billing department for review.

Then on 7 March 2017 I received an sms stating that I used dada out of bundle and have an account of R66 payable.

When I phoned the call centre now (08/03/2017 11:15) to enquire as to how it is possible for me to have to pay an account if I am on pay-as-you-go, I was simply told to call back because their system is not working...

I am fed up with MTN just taking money from me even after I disputed their agreement with me and have proof of cancellation of the said agreement, twice now!!!

They also committed ***** by deducting money from me to the amount of R132.28 (which was for 2 months outstanding plus intrest while CCI dragged their feet to process my cancellation) on 1 February 2017 after the contract was cancelled due to ***** by CCI.

They committed ***** by deducting money from me to the amount of R76.50 on 1 March 2017 after I have various correspondence in regard to a confirmation that the contract they charged me for was cancelled already in January 2017. I was not clearly informed that after 27 January 2017 I was still under contract with MTN and that only the upgrade was cancelled. This was an error and miscommunication from their side and I refuse to pay for their mistake.

I also refuse to pay the current account of R66 as I am no longer under contract from MTN but a pay-as-you-go customer and therefore their should be no out of bundle charges towards my number.

I want no further excuses from MTN. They currently owe me R76.50 and by the way they handle queries, I fear that they are going to deduct this R66 as well at the end of the month which they have no right to do.

This issue with MTN is now entering the 5th month and I am done being taken advantage off
