Faulty phone sold while store had been warned to not sell said phone

September 2016 I was sold a SONY M5 from Paarl Mall MTN. In October it started to just switch off without warning. My Uncle's, brother-in-law is a SONY repair engineer and immediately rep**** that the phone was not supposed to be sold to me as it had been retracted. I held on to the phone for a while hoping the problem would go away but it didn't, so I took it in to another MTN store in the beginning of November. They informed me that the store in Paarl was indeed not allowed to sell me said phone and spoke about a mail sent in August that the nxt store that sells an M5 will get a written warning. Eventually the case returned as a warranty assessment with papers that state that I am allowed to get a new phone. However, according to MTN Paarl, this letter is false, as contracts have become more expensive. THey now want me to sign a new contract for either a much cheaper phone, or pay more money per month. The first example we looked at that I can get for the same price is R2200 cheaper. This means that except for me losing the money I spent on M5 accesories (about R500 altogether), I also lose R2200. Not to mention the 2 months since beginning November that I have been paying for a phone that I don't have.

On top of all of this, the time is a frustrating issue. It has been two months now that I am waiting for the issue to be resolved. I have been back to MTN Paarl 4 times since the warranty assessment and I work 8km away. Since I normally go during my lunchtime, that's a further 64km worth of petrol(16km x 4)and 4 lunchtimes that I have lost because of MTN Paarl's mistake/ deliberate disobedience of headquarter rules to suit their own sales.

This is completely unacceptable!

Thank you Siphumezo, but when you took too long to respond I resorted to facebook and received a reply. The matter has been sorted out (They refunded me for the amount spent already and started a new contract - I have already received the phone) and nothing further is necessary.
Kind regards,
Marina
