Failure to disclose terms & agreements of contract
Good Day
On 15th October 2015 I accepted a cellular upgrade telephonically: MTN My Choice 200 with Apple iPhone 6 at R579.00 per month on a top up basis. I was not sent a copy of this contract with my phone and it was only once I started to be billed for the phone did I realise that it was costing me far more than I had anticipated. I had explained to the agent that I needed a cheaper package than the one I was on at the time and at no time do I recall being told that over and above the R579.00 per month that I would be billed an additional R250.00 per month for the handset. I emailed MTN customer care on early in December 2015 and they responded on
10 December advising that I was liable for the additional R250.00 per month for the full 24 months. I then asked them to get a copy of the recording of the phone conversation where I was advised about this and , to date, I have received no further response. They also failed to respond to certain other billing queries in my email. In terms of my consumer rights I should have proof of full details of contract in writing with the option to withdraw in a certain period if I am not satisfied. Dealing by email is not user friendly.
