Can I have my phone back in working order

Its four months now and am still without a working phone infact its still at mtn yet they have a policy that says if you dont claim your phone within 3months it will be sold <br> Yet with me I have already paid but my phone is still not working even after four months <br> So I am not sure whats mtn s problem instead all I got is silence and everytime i have enquired as to whats happening I get apologies for the delay I am tired of these apologies can I have my phone back now If mtn cant fix the damage they caused to my phone lets continue with fair business Can i have my phone replaced I dont want another apology from mtn but my phone I also have my life to run through my phone I have not been inconvenienced but I have been disorganised thanx to mtn keeping my phone at their centre for 4months and please to who ever will respond to this Once again I dont want an apology from mtn but my phone in working order what I have paid for I am tired of those I need a proper response is mtn *****ing my phone am i ever going to get my phone back? If yes when? can i get a commitment of service from mtn as to when my phone will be returned cause seemingly its indefinite
