Breach of contract !!!!! PART 3

I AM POSTING THIS AGAIN SINCE I NOTHING HAS BEEN RESOLVED DESPITE MTN SAYING THAT IT WAS. On 2 August 2018 I reported to MTN Cape Gate in store that my account is being debited incorrectly. We have also corresponded via email numerous times and I have provided MTN with my bank statements. To date my account has not been corrected, after MTN Cape Gate told me that it was a system error. My account was debited for another incorrect amount (R300 more than what it should be) on the 1st of September. I had to reverse the debit order, which cost me R60, since I had already paid MTN the amount that I owe them before the 1st because I revoked MTN’s authority to debit my account. I have fixed 2 contracts MTN! I am being billed for an account that I never agreed to. When I phone the call centre they say that it is because there is no cap on my 0833 number. It is impossible that my account was running smoothly for the first few months and now all of a sudden I have no cap on my account. MTN Cape Gate told me that it was a system error. So either they are being given incorrect information, or MTN has been experiencing a system error for 4 months now. Them MTN has the nerve to send me an sms to say my query has been resolved? If this “cap” issue is not sorted before then end of this week (Friday 7 September 2018), and I am not refunded for the other debits as well as bank fees by Friday – I will go in to the store and give MTN back their device and cancel my contract on ground of breach of contract. I am not paying R353pm for a Huawei P8 Lite of all phones, when I signed a fixed contract for R169! Further to the above. I have now reported MTN to the National Consumer Commission (NCC) sine MTN has ignored me and has done NOTHING to rectify this matter. I will not let this matter go like I did when MTN committed ***** on my account in June 2017 by falsifying my signatures. I have contracts in place, they are there for a reason.

27 Sep 2018, 9:28 ADV18: Hi There, Please call me, my issue is still not resolved and I have still not been refunded. Was the amount credited? If so what do I need to pay for October? I am still getting sms's to say I am "reaching my usage limit" Please call me asap 27 Sep 2018, 15:44 ADV18: I have been informed that I have to yet again pay R750 next month. How can this be when there is a R640 credit on my account???? So in short, nothing has been fixed on my account. I have not bee refunded despite receiving an sms, and my query has not been resolved, despite receiving numerous sms's saying that it was. I would like to cancel my contract with immediate effect and want to be refunded the R640 I was promised as rightfully belongs to me since I was over debited.

Hi Alice, What exactly do you mean by usage limit is set up on the device to R0.00?? I have a fixed contract meaning if my airtime, data or sms's run out I am supposed to BUY airtime. I do not have an open contract. Second, I asked MTN to REFUND me. Not credit my account. Shall I send you a copy of my contract so that you know what contract I have. No one can seem to understand this. Thirdly, you are not addreessing the addisional services that was activated on my account without my consent. I assure you the mistake is not on my side in terms of usage limit being set up on the device to R0.00. This is on MTN's side. MTN must fix this. How can I set my device on 0 usage when I actually receive data and and must use it. Your reply makes absolutely no sense. I have a fixed contract meaning if my airtime, data or sms's run out I am supposed to buy airtime. I do not have an open contract. Fix this. Since MTN will be crediting me again if this happens. Whats the point of MTN crediting my account but not FIXING the actual problem on my account?

Please advise on how to change the "usage limit" on my device. The store says that there is no such thing. First it was a system error, then Siswe (Complaints Analyst) said it was MTN's mistake (hence the reason WHY I was refunded) but never corrected the usage settings on MTN's side. And now you are saying that this is my fault because I changed a setting on my phone? Let me see if I understand this correctly.... you are saying that even if I have a fixed package, I can rack up thousands of rands in data usage and calls simply by changing a setting on my phone?? Without MTN's approval or without credit approval? How about I put that to the test and see if I can reach a R10 000 bill. Then I will just not pay MTN and see if and when MTN finally decides to cap and correct my account like it's supposed to be . Funny how in all of 10 years that I have been with MTN, on all the fixed contracts that I've had, that I've never been lucky enough to discover this setting on my phone when I really didn't have money for more airtime. Fix my contract or I will be cancelling it! MTN is in breach of contract. It is not a setting on my device. MTN has opened my contract to rack up more charges. Even the call center agents are able to tell me that this is a simple setting on their computers. fix it.
