Blackberry 9790

I send my phone in for a software update, just to find out it is out of its warranty. I told the lady that it could not be as i bought the phone late December 2013. She send me the invoice of the blackberry with my IMEI number who was sold on a top up contract in Sept 2012. How can one phone belong to 2 people and why must i be punished because i bought a NEW phone in packaging. I need someone to help me to understand how this can happen and what are they going to do in order to give me a new phone that i have purchased on the 24 December 2013. Please note i have my receipt and the one allocated to the top up. It can be emailed if requested.
