Abused by MTN Store Manager in Cape Gate Mall - Store code 0037

To Whom It May Concern

I would like to lay a formal complaint against your very unhelpful and rude store manager at the MTN branch in Cape Gate, I took out a upgrade for the I-phone 7 plus(x2 I-phone plus) on Friday 2.12.2016 I told the store advisor Joseph that there was a nick on the phone and I wanted to exchange it in store on Friday when I done the upgrade, he told me there isn’t stock. I then proceeded to take the phone and he said if I’m still not satisfied I should return the phone within the 7days .When I removed the plastic cover that is around the phone to put on a screen guard I noticed that the screen is cracked and there is another mark that you cant see when the plastic is on (I saw the crack last night (5.12.2016 ,3rd day of the contract). 1st this this morning I went to the MTN store in Cape Gate and got ********** treatment from Noleen Bailey manager.

She kept saying it is physical damaged and I (me the client) assessed the phone (ITS NOT MY JOB TO ASSESSS, IM THE CUSTOMER !!!!!). She pretty much made me out to be a **** in front of my husband, staff of MTN and other customers. If I had dropped the phone I would’ve been honest that’s why I have insurance!!!!!!! I came back to the same store because I know that the advisor knew about the fault, why would I lie?!!!!!! Your store manager Noleen Bailey told me very loudly in no uncertain terms that I am RUDE in front of my husband, staff and other customers. Is this deemed as acceptable?

Noleen Bailey, store manager at Cape Gate branch laughed at me, patronised and accused me of dropping the phone, New I-phone 7 plus, this is disgraceful behaviour from a member of any customer service industry.

This is completely unacceptable and after consultation with my attorney I was told that I was within my full right to have the phone replaced within the timescale. I demand that my phone be replaced with a brand new phone as this is what I ordered. I have been a loyal customer and I expect to be treated as such, your store manager left me in tears at the store. Noleen’s emotional abuse and belittlement had me so upset that I was in tears that I had to medicate in order for me to calm myself down.

Consumer Protection Act 68 of 2008 upholds the liability on the service provider to exchange the goods like for like.
Refusal by store to exchange the phone within the 7 day period is in breach of your return policy. I would like a new phone please and will return your damaged goods.

I would like an apology from this store manager and I want my NEW PHONE .Id like for something to be done about this unacceptable behaviour .

I would like feedback ASAP

Tamara Henshaw-Dann

********** 783
