7 Days Return of Defective IPhone7

Hi Hello Peter,

My iPhone7 7 Days old

A few weeks back I complained about my few month old Iphone7 that was giving me problems well low and behold my phone eventually died so I took it back last week to the REPAIR center and they replaced it. So on Wednesday 29/11/2017 they gave me a brand new iPhone7 which I was happy about about but 5 days into getting my new IPhone7 my new phone now gave me the exact same fault the first one did so I decided to take my phone back to the pavilion store today 06/12/2017 being the 7th in which I received my replacement phone. Upon arrival I was told by (Felicia) that I would have to book my phone in for repairs I said I would not accept that fact that my phone was only 7 days old that it needs to be taken to a repair center, so I said I would like a replacement phone because my phone is an OBF within 7 days of receiving she says no today is the 8th day I don’t know what time Zone MTN is living in but I know today is only the 7th day and I know for sure my phone is within the 7 Day Return/Refund policy.

So the Technician (Nirmal) tried to diagnose the fault with my phone but I did state that it was an intimitant fault with the ring/notification sound but he said he will not be allowed to replace my phone because it has an itimitant fault and that they would need to see or hear the fault which I did say is impossible due to the fact that it happened to me twice in the past 7 days. And if they replace it and there is no fault found on the device that they would be liable to pay for the phone which i think is hogwash.

There is no paperwork that I received in writing that I signed to state that the phone new iphone I had received had a 7 day warranty starting from 29/11/2017 being the first day because I would have then brought it in the day before which would have been yesterday.

So I then waited almost and hour to speak to the second in charge (Siva) because the manager had already left for home. But he gave me the same sad story about the phone being out of the 7 day return policy.

I will not accept my phone that is 7 days old to be taken to a repair center. I demand a replacement phone because I returned my defective device within the 7 days and I will not continue with this defective device for the remaining of my contract.

The law states that I can replace my defective item as long as it is in the 7 day return policy or I can get my money back , I will not accept this from MTN or any other place!!!!

We as consumers have RIGHTS too and this time I will not be taking the back seat about my 7 Day old iPhone7 and if this can’t be done then cancel my contract with MTN, waiver the termination cost and refund me for all the months that I paid for my new contract and I will move to another service provider if that’s what you want.

And by the way the Pavilion store does not under any circumstance answer the landline phone I’ve called that store for weeks and no one answers the phone and the reason behind that is because Walk-in customers take preference because my number change that I requested and paid for on the 17/11/2017 was never processed on the system and I had to return to the same store 3 x to sort out a number change because the store does not answer the telephone. That type of service is unacceptable because I had to keep on driving to the store. But after 2 months my number eventually got changed but I never received a call notifying me about my number change. I wanted this sorted out this week I would appreciate a call from MTN
