I was phoned by Khanyi Mkhize from mr price mobile who offered me a Samsung J5 cell phone for R99 pm. I informed her that she should contact me later as I wanted to check something with my mother. I wanted a phone which my elderly folks were comfortable with as my mother battled with her Chinese phone and my dad had a Samsung. I then spoke to the consultant later who said I was one of only 200 people being offered the deal and that I would lose out if I did not take it immediately. I signed up and a phone was delivered within two days by ram couriers. Not being fami**** with phones I opened the packaging to discover it was in fact a mobicel. I immediately phoned the help line, only to be informed it would take them 2 to 5 working days to listen to the tape of the conversation to establish what to do. I made it clear that it was not suitable but they said I had to wait. When nobody got back to me after 5 days I phoned them again and they said that it was only 4 days but that somebody would definitely get back to me by the Friday the 13th October. On Saturday 14th I again phoned to be told that it was still pending. I lost my temper and told them off whereon they put down the phone. On phoning them today I am informed that they had listened to the conversation and that I was definitely offered the phone sent. I would definitely not have taken it if I in any way was made to understand that it was a mobicell I had had to tell the person on numerous occasions to slow down and that she was speaking too fast but they seem to have the ability to do as they please, and if they managed somehow to slip in there the name of the cell phone sent, or have in fact doctored the recording I would like to know. They inform me that the sim was activated on the 10th of October. Why would mr Price activate a sim for a phone delivered on the 5th and immediately rejected on the same day, 5 days later and 5 days after I had complained that I did not want it, and still not answer your queries timeously as promised. You have to wait for them to collect the phone as they do not have a place you can take it to. I had seen an offer over the weekend from someone else also for R 99 for a J 2 which was more in line with what I had requested originally, but due to mr price being able to abuse us, and lie about timespans could not do anything about it. mr Price also claim that they are now entitled to charge me R380 for cancelling this. I have been told they would let me have a copy of the conversation but this has not happened and I will be approaching the National Consumer Commission and NCR.

Siphembile phoned me on the Monday and confirmed the address to uplift the phone and said she would be investigating the matter. Late Thursday as the phone had still not been uplifted nor the recording made available I again had to phone them and they had to find her and have her return my call. This resulted in the transcript at last 2 weeks after the event, being made available, where I can hear that the lady had said that it was the same as a Samsung j 5. In an office full of people talking and with printers going and with someone who’s accent made the words very difficult to understand, this was not what I heard. I had heard it as Samsung, Samsung J5. The name mobicell is mentioned a number of times but I had no idea that mobicell was a make of phone at that point, and assumed all the time that it just meant the j5 mobile cellphone. When it arrived at my office and someone pointed out to me it was not a Samsung J5 I immediately phoned MrP rejecting it. It was only after listening to the conversation I put two and two together that it was in fact the make they were referring to in mentioning Mobicell. I have been informed by lawyers that I had 5 working days cooling off period, and the fact of the matter is that I rejected the phone from the start. Not because I changed my mind, but because it was not what I expected, and was not suitable, all be it through a misunderstanding or confusion, and the very reason the consumer protection act is in place according to the lawyers.. MrPmobile in trying to force me to take the contract are doing themselves no favour, and bullying tactics, while wasting ones time, and not uplifting the phone as promised only aggravates the situation. I wanted to deliver the phone thereby saving them money in courier costs etc, but this they would not allow either. I have reported the matter to the national consumer council and am waiting for there response.
