Selling new vehicles with software issues

I purchased a brand new Vw polo 1.4 tdi Highline on the 27 August 2016 on the 31 August 2016 the engine management light came on while driving to work. I contacted Vw SA to take the vehicle back to the dealer and fix the problem, to my suprise after they say there is no fault and the software of the vehicle needs to be updated which they do not have but will be available in November. i took my car back and used it for 7000km now the engine managment came on 3 times already and still they dont have the software. i told them to take the car back and cancel the deal because it is obivous i was sold a defective product and i will buy another new vehicle just not a tdi. The dealer principle says VW SA must make that call so i contact VW SA and they say the deal principle can do it. So between VW SA and the dealer principle nobody knows their job or have some sort of authority to decide. i just dont want that tdi anymore.
