Not responding to respond to buyer of vehicle
SUPPLIER
Top Speed Motors
BRANCH / AREA Vereeniging COUNTRY South Africa
TIME / DATE 09:15 Mon 16 Nov PERSON RESPONSIBLE Johan Fritz
CUSTOMER Helberg View all reports by user 2
HEADLINE
No damages paid
After informing the motor dealer of the changed engine that we where not informed about during the transaction of purchasing the vehicle, via a letter from a lawyer, the dealer did not respond favorably. I contacted the MIOSA (Motor Industry Ombudsman). They looked at the evidence and wrote a letter to this dealer to compensate me for my damages within 31 working days from the date of their letter on 9 Sept 2015., using the Consumer Protection Act 68 of 2008 section 49 subsection 4. The dealer did not make any effort to contact me or the ombudsman or make any arrangement whatsoever. I have now reported it to the National Consumer Commission. I have had about R30000+ of damages to date to this vehicle which I bought just over a year ago in Aug. ABSA has paid an amount to damages through the motor plan but this was not part of the +-R30000 damages to date. The dealer responded on the hellopeter report and said that the MFC is still busy with investigations. Please respond.
Dear Helberg
As discussed this is a matter between the purchaser and the dealer.
MFC may not intervene as the vehicle in question is not financed by us.
We suggest the matter be referred to the purchasing dealer.
Kind regards
