MFC not taking responsibility for damages to my vehicle

On April 28th, 2022. my vehicle, Kia Sportage 2.4 AWD, was uplifted from our home after I could not make payment of the vehicle after 3 consecutive months due to not getting any income since November 2021. My new work in The United States started April 10th 2022 after a delay from February 15th 2022.

The paperwork was handled professionally by the lady from MFC Klerksdorp branch, i asked her how the vehicle would be moved and she told me that the vehicle would be moved to secure storage in Klerksdorp but if they do not have room for it it would be moved via lowbed to the MFC facility in Johannesburg.

I then asked that they must take good care of my vehicle as i was in the United States April 10th 2022 starting my new work, she assured me that the vehicle was going to be looked after.

On May 14th 2022 i made a payment of R20 000.00 and May 16th R1203.00 that was required to release the vehicle only to be send an Email with added amounts for towing and storage of vehicle.

After paying R7190 my vehicle was ready to be picked up from Johannesburg MFC Auction House.

My wife then went to pick the vehicle up on May 26th only to find out that the vehicle was driven 163km. My wife took pictures of the odometer when it left our possession. And when she received it back. She notified me she had picked it up from MFC Auction House.

She phoned me less than 2hours later complaining that the vehicle is not driving the way it was supposed to. There was an engine noise and when she arrived home there was a noise when she wanted to put the vehicle in Park and Reverse.. she then hystericaly phoned me awake in the USA and told me something was not right with the vehicles transmission and engine.

I immediately send a mail through to the lady asking who was driving the vehicle and who gave permission to drive the vehicle 163km while i had to pay Towing costs from Klerksdorp.. she then rep**** that the vehicle was driven from Klerksdorp to Rustenburg and then towed to Johannesburg. They cannot provide me with a valid insurance policy for the movement of the vehicle too

My vehicle is an All Wheel Drive Automatic transmission that cannot be towed and must be moved on a Lowbed.. i instructed my wife to leave the vehicle parked untill i can resolve the issue.

MFC said that they would not take responsibility for damages to my vehicle when it left the Auction House. Clearly something happened to my vehicle while it was in MFCs possession because when it was signed over to MFC it was in perfect condition.

Many emails later and still no clear answer i had a gearbox specialist come out to assess the vehicle to find out that a link on the transmission broke and it would cost R28 000 to replace it.

Send the email to MFC and they wanted to put the blame on my wife.

Which they cannot do as the vehicle was in perfect order when it left our possession, but was not perfect when we got it back.

MFC then said they are going to investigate the matter and get back to me.

I then had the vehicle fixed as it is my wives only means of transport while MFC was investigating the matter.. still to this day there is no feedback on the matter that the vehicle was driven 163km without my consent and was damaged while in MFCs possession.

I want to know who is responsible for the R28 000 worth of damage caused to my vehicle? I hope this gets resolved soon now as i am waiting almost a month for feedback now. I am currently working in Arkansas, United States of America and now i have to worry about my wife getting by in South Africa while MFC is "investigating" the matter with no clear answer
