MFC Nedbank - Unfair court judgement

MFC helped me to finance a Toyota quantum kumbi in 2023. I took the kumbi for my brother who could not pay it anymore. I started getting messages that a few payments were missed that is when I realized he was not paying for it anymore.

Early 2024 I was then contacted by Jinet from the FDE collection - That is how she introduced herself on Whatsapp. She said that the reason for the WhatsApp was because she tried to contact me to no avail. We then talked and I advised her that my brother has updated banking details and the debit orders should go through for the payment, only to find out payments were bouncing bank because the account did not have money.

I ended up telling Jinet that it seems like he will not be able to pay, and I then asked her what are the chances to cancel the contract, she then said I can surrender the vehicle and sign a termination contract. I then asked of the charges, then her response was 'No charge, they will just take the kumbi to auction then sell it' Then I asked where can I return it, and she confirmed that the agent from the bank will have to come and collect it. The collection was then arranged and the kumbi was taken.

Few months down the line, I start getting calls from Nedbank stating that I owe them R213 075.33 after the auction has taken place. I then went back to my Whatsapp and spoke to Jinet and asked her if she did not say then when I return the kumbi I will not owe anything. Her dexact response was 'Let me follow up with the controller because the kumbi was new. Maybe the is a misunderstanding, I will give you feedback' and this was on the 26 January 2024. On the 2nd February 2024, I reached out to Jinet again and her direct response was 'Morning, I have asked the controller and he is waiting for feedback. Sorry for the late reply was on leave'. On the 14th of February 2024, I sent her a WhatsApp message reminding her of the feedback to no response till date.

I then decided to call MFC and was told that my account was handled by Gotsi Maine. I then receive an email Pabetsi Molapo who on email made a breakdown of the amount I owe after the auction.

I then responded to her and advised how is it possible that I owe when I was told that I will not owe anything after surrendering the vehicle, I even provided proof which my WhatsApp conversation with Jinet from FDE collection. Then Pebetsi Molapo responded to my email, and her part of the response was ' Please note that I cannot speak on behalf on "Jinet" on what was discussed between her and yourself' - That firstly shows that this person "Pebetsi" does not sympathize and definitely did not even bother reading the proof that was provided. Such a bad and disgusting service from a black or should I say pedi lady like myself?! And she ended the email with how we cannot dwell onto the past as it will not take the the matter forward. I am not really sure that this girl was really referring to that huge amount when she said 'the matter'.

I then received an email from from Siphesihle Magubane, last email. Siphesihle said the same thing that Pebetsi said and said that the bank will not force me to pay the amount and said that they will proceed with legal actions to obtain a judgement against me.

As I write this review, I have a judgement on my name however no one even bother to investigate or anything. I surrendered the vehicle after I was told that I can do so with no charge, does that not matter? Why would I surrender knowing very well that I would still owe the bank? I would've sold the vehicle myself and paid off the debt or even better, I would've done something with it that would have helped me pay the installments moving forward.

But guess what? I decided to surrender the vehicle because it was free and hustle free, saved me the stress of planning everything. After that, I am forced to pay R218 000 as if that is just R1000 and on top of that I have a judgement on my name.

I am so disappointed in all the agents I've mentioned who failed to assist me when I needed help the most. Who failed to even check my communication and investigate. And , who went ahead to put my name in the mud and continued with their lives, while mine is and will continue to be stuck for the coming years.
