FORMAL COMPLAINT AND URGENT INTERVENTION- CAR REPOSESSION
I am writing to formally lodge a serious complaint against MFC Car Finance regarding the ******** repossession of my vehicle, poor service delivery, and the complete lack of proper communication and due process.
I have been a paying client and have consistently made monthly payments on my account. While I did experience financial difficulties last year that resulted in temporary short payments, I have since resumed paying my full monthly instalment and have been paying additional amounts toward the arrears. I am currently in arrears, with an outstanding arrear balance of around R11,200. Despite this, I have made ongoing efforts to regularise my account in good faith.
On Thursday, I contacted MFC and reached a payment arrangement with a consultant named Tamon Meyer. I was under the clear impression that this arrangement was accepted and that the account was being managed accordingly.
To my absolute shock, the following day my Bolt driver, who was operating the vehicle at the time, informed me that he had been stopped by an individual named Muzi Madonsela. My driver was pressured and forced to sign documents to surrender the vehicle. I immediately instructed him not to surrender the vehicle without a valid court order. Despite this instruction, the vehicle was taken.
My driver is a third party and not the registered owner of the vehicle. At no point during this incident was a court order, warrant of delivery, affidavit, or any official legal documentation presented to him. I personally received no prior notice of repossession, no summons, no communication confirming legal action, and no indication that a court had authorised this repossession/Restructure.
Initially, Mr Madonsela informed me that he would send me a copy of the court order and affidavit. I have proof of this communication. He later changed his statement and advised me to contact MFC directly to obtain the documents.
I then contacted Tamon Meyer and requested escalation to a team manager. The consultant I spoke to was rude and dismissive and provided me with a manager’s contact number ***). I have repeatedly called this number since Friday without success. I was informed that I would receive a call back on Monday. It is now Monday, and I have still not received any communication from management, while my vehicle remains in storage.
This situation has caused me significant financial and emotional distress. The vehicle is used for income generation through Bolt, and its removal directly affects my livelihood. I find it deeply concerning that a vehicle can be repossessed without presenting a court order, especially after a payment arrangement had just been made.
I urgently request:
Written confirmation of the legal basis for this repossession, including a copy of the court order and all supporting documentation.
Immediate clarification from MFC management.
A review of the conduct of the individuals involved.
Urgent resolution of this matter.
I believe this matter warrants immediate investigation and intervention. I am requesting that MFC respond formally and without further delay.
