Financed previously WRITTEN OFF CAR... Is the contract even legal???

So, we bought a car from a dealership in April this year. I got hold of the previous owner and she told me that it was impossible that I was driving the car as it had been written off in an accident she had.

I phoned MFC a few times to make sure that they do not finance previously written off cars and every time I got the same answer... "No sir under no circumstances do we finance previously written off cars"

I made a complaint to MFC regarding the fact that the car was indeed written off with a 12page assessment with images as well as a letter from the previous owners bank that states clearly that the car is in fact written off.

MFC did nothing to rectify this and sounded like they are more on the side of the dealership that sold us the car than on the side of the client and the person that "helped" us said that MFC is just a mediator. The dealer wanted us to pay R25k to take their previously written off car back and MFC did nothing. According to me the contract means nothing as this car was not even supposed to be financed in the first place.

I wish I could get hold of someone higher up besides the customer care dept as they just say that they are only mediators in this entire mess and it can be sorted out between us and the dealership that had promised us that the car was not in an accident and that a lady had traded the car in because it was too big for her...

We took the car back to the dealership and they wanted to load the interest of the new car to the refinancing of the old car and even told us that someone from the bank was there and the story was explained to them and that the person said it is okay that way.

We want this ********** contract cancelled as it is not even worth the paper it is printed on as well as the money back we spent on the car thus far. We will gladly go to another dealer to find another car.

What to do now or is this the way it works now? You finance written off cars???

I phoned a few times regarding this and just asked the question if MFC finances previously written off cars and the answer stays the same "No sir we do not" and yet we are driving one.

When we told the customer care person that we will be going to the ombudsman they did not even reply to the mail.

That does not answer the question of how legal the contract is... Nothing was done about it. Emails were just sent from us to the dealer and the dealer to us... How did that help at all?

I still do not have any feedback on how legal this contract is... I phoned a few times and asked the person that answered the phone if you finance previously written off cars... AND THE ANSWER IS "No sir we do not do financing of written off cars" That makes this contract pretty ******* and that is why Shawn Fillander and Sandile Mkhungo does not answer the question...

We have been in contact with Shawn and he made it clear that he is only a mediator between us and the dealer. I still want to know how legal this contract is because of the fact that you do not finance previously written off cars... We are driving one financed by you... So you are going against everything that you say you do not do. According to me this matter needs to be resolved between you and this dealer. They **** to you as a service provider and you did not pick it up when financing. Please see the last mail from Shawn below, where it sounds like it is okay what the dealer did and making it our problem. "Good day Unfortunately, MFC as the financier has no jurisdiction over the dealer. Therefore we are unable to demand the resolution you expect from the dealer. In the alternative you can sell the vehicle and settle the account in full. Note that MFC will not agree to the sale and return ownership and title to you unless the full outstanding amount is settled or you can apply for finance for the trade in. You can get legal advice and make this a civil matter between yourself and the dealer, noting that you remain liable for the monthly instalments on the vehicle. Kind regards"
