Beware of *****ulent product offerings
My daughter recently purchased her first vehicle. A few weeks later she received a call from MFC Vehicle Finance Assist telesales consultant informing her about an additional Death, Disability and retrenchment benefit / policy.
At no stage did she consent to or accept this product via any means of communication. Despite this, MFC Telesales – operating under Direct Independent Brokers – proceeded to initiate the product in her name without her informed or written consent. A policy document was subsequently emailed to her, reflecting a monthly premium of R299.63.
Consumer Protection Act (CPA), No. 68 of 2008 Section 48(1): Prohibits unfair, unreasonable, or unjust contract terms.
Section 49: Requires clear disclosure of terms, especially if they are significant or financial in nature.
Section 31 (Negative Option Marketing): Prohibits any practice where silence or failure to reject is treated as acceptance.
Section 41: Prohibits false, misleading, or deceptive representations.
She has subsequently sent an email to ***, requesting that the product/policy be cancelled. It remains to be seen if this will be processed.
