Unsolicited calls

I received a call from Mondo about some random offer. I am on every do not call, do not disturb list and I still don't know where they got my number from.

Since I didn't share my information with them, it constitutes unsolicited communication in terms of section 45 of the Electronic Communications and Transactions Act (Act 25 of 2002)(ECTA), as read with section 11 of the Consumer Protection Act (Act 68 of 2008)(CPA) or alternatively, as the case may be, Section 69 of the Protection of Personal Information Act (Act 4 of 2013)(POPIA)

I demand a phone call from their management (no numbers are listed on their website). Please note that a failure to comply with this request within 24 hours constitutes a ******** offense in terms of section 45 of the ECTA and that the continued receipt of unsolicited communications may lead to prosecution. Additionally, I hereby request that you immediately disclose where you obtained my contact details, as per section 45(1) of the ECTA and/or section 22(1) of the POPIA. Failure to respond to this request may also constitute a ******** offense.

Hello werneravr,

Thank you for bringing this matter to our attention and giving us the time to speak to your directly. We trust the information you have been furnished with has provided you with the required information.

We are aligning our business to upcoming legislation to the POPI ACT. POPI will bring a proper Do Not Call list into play, that is a legal requirement to abide to.

As one of Vodacom's Trade Partners, we always ensure that customers are treated fairly and would never contact a customer if we were informed not to. These errors do occur at times as we outsource our data from different Companies.

We apologise for any inconvenience caused and can assure you we will not contact you going forward. Your details has been added to our Do Not Contact list.

Should you have any further queries, please do not hesitate to contact us on ***.

Regards,

Mondo Support

Best regards,
