Misleading cell phone upgrade, and breaching of The Consumer Protection Act 68 of 2008 (CPA)
The consultant contacted me on 2021-010-5 whereby I was offered an upgrade on both by sim cards.
I initially declined however the consultant did explain to me that the upgrade is a month to month option as I need to get both contracts moved of my name as my company will take over the account. This was explained to the consultant multiple times and she assured me that the contract's is on a month to month basis.
I only realized today Friday 2020-01-08 that both contracts were now uograded and the contract is for 2 years. This is exactly what I did not want.
I have contacted the call centre and they refused to reverse the upgrade. This is *******
The Consumer Protection Act 68 of 2008 (CPA) which came into effect on 31 March 2011. The primary aim is to provide for protection to consumers. Section 16 (3) of the CPA provides that a consumer may cancel an agreement that resulted from any form of direct marketing, without any reason. The consumer should only within 5 days from the date of the transaction or agreement.
