Surrender still not sorted out
<p>I've been trying to surrender my policy for more than a month now and no-one in your 'call centre' seems to know what to do and even what the cash value of my policy is. this policy was taken with my ex husband. All the necessary documentation was submitted. I am the policy holder. I am convinced your *********** staff will pay the cash value into my ex's account and not mine as stipulated in the many emails that was sent by myself and my finanical advisor. </p>

I was a bit hasty in posting my previous comment - I have now been informed by our Quality department that they are not able to approve payment as not all requirements are met. You and Mr Manick are joint owners of this policy. We therefore cannot surrender the policy on your request alone. As you are both owners of this asset, there are other requirements that you need to conform to. Our legal department have advised that the divorce decree is not sufficient, and we require a settlement agreement wherein you and Mr Manick have agreed to divide your assets. Please can you provide the settlement agreement so that we can continue with authorization of the payment?

This was almost 8 years ago. How do you propose I get a settlement? Please send me your email add as yet again, your inefficiency levels surprise me.

If this payment was spilt between both parties then it is unacceptable as I'm trying to get my settlement from my lawyer. You did not allow me time to the info and made a decision that was unacceptable. How to you propose to remedy this once i send through my settlement?

As stated in my previous correspondence - you and Mr Manick are joint owners of the policy. Therefore a surrender of the policy is paid to both joint owners in equal shares. I am sorry that you are unhappy that only 50% of the surrender value was paid to you, however as you did not provide Momentum with a settlement agreement that we asked for in the previous comments, the legal position of the policy which Momentum is obligated and required by law to abide to, was to to pay the proceeds to both owners in equal shares.
Momentum's obligation on this payment is therefore fulfilled. You will need to approach Mr Manick in your personal capacity for compensation or settlement if you are of the view that his portion belongs to you.
