I refer to our subsequent telephone conversation.
As discussed with you telephonically, the Pension Fund Act does not provide for a commutation of a Retirement Annuity before the age of 55 years if the holdings in the fund is above R7 000. Currently, the holdings in your Retirement Annuity policy is above this amount. The only exception to this law is that a member may take early retirement before the age of 55 due to ill health.
I am truly sorry to hear of the difficult time that you are going through with your illness, and hope that we can find a way to assist you. It may be that you do qualify to take an early retirement due to ill health, provided that the severity of your disease does meet the qualifying criteria of a critical illness claim.
I have sent you an email with Momentum's requirements and forms to be completed and signed, in order for Momentum to consider a claim for early retirement due to ill health:
The additional requirements that you will need to submit together with the forms are specified on the 1st page of both forms. On receipt of the necessary requirements, the claim will be assessed by a Senior Assessor in our claims department to determine whether you meet the qualifying criteria.
In the event that you do qualify for early retirement due to ill health, you will be able to commute the full 3/3 value subject to a tax directive.
We will therefore wait for you to submit the necessary claim form and requirements to Momentum in order to consider a claim.
