Momentum literally broke the law
Momentum had sent me my contract in Afrikaans instead of English. I had requested it numerous times throughout the years but never kept proper records but I have at least 3 emails where it shows I requested it and they still never sent it. This lead to me having to use their website for information as that was the only place I could get the information in English.
Their website is not actually correct with all the information which is why I was paying under false beliefs.
I took this matter to the ombudsman but the ombudsman did show bias, which is why I will be seeing how to have them investigated. Proof of bias is that Momentum staff and ombudsman dealt with each other on a first name basis (this shows that they have a friendly / acquainted relationship) so this was not kept completely professional, the ombudsman contradicted themselves in the findings to be in favour of Momentum and the ombudsman stated that the contract being in the wrong language is ok for basic understanding, which is obviously not at all ok because a contract in the wrong language is not ok. I also have proof that Momentum **** to the ombudsman about one of my requests for the contract having ended up with me receiving my contract, which is not true and have brought this up with the ombudsman but they don't care which is why there was obvious bias against me. It was decided that a compensation of R 1 000.00 would be offered for "poor service". This is obviously not acceptable after having had the policy for nearly 19 years, R 1 000.00 was less than the monthly premiums and this is not a matter of poor service but actually a matter of Momentum breaking the law.
As this offer is obviously nothing less than an insult and they refuse to compensate by a full refund, which was requested at the start and then changed due to Momentums handling of the matter and being factually incorrect during the time dealing with the ombudsman, I have now been left with no choice other than to start taking legal action against Momentum for their contraventions of the Long Term Insurance Act 52 of 1998 in regards to 48(3) - The policyholder shall be entitled to be provided, upon request, with a copy of the policy. I also have an email from the Momentum investigator stating that there was a request for the contract and that Momentum never sent me a contract. I have also requested a phone call from 2011 which after 6 months now they still have not sent.
