...the third party was evasive, hence we have proceeded to abandon the recovery....

I took out car and household insurance with Alexander Forbes in 2013 and had no issues until AF was acquired by Momentum. Following up an insurance claim from early 2019 regarding the recovery and reimbur*****t of my R3250 access payment (3rd party bumped into the back of my car at a red traffic light - there was never any doubt that the insured 3rd party was 100% at fault) I got the following reply from Momentum: The other party did not come to the table or co-operate with our attorney. In this particular claim our total costs we needed to recover from other party is just under R12000.00 and if we were to embark on litigation (issue summons and proceed to court) it will costs us no less than R15000.00 on legal costs- so it will make no financial sense for us to embark on litigation. Hence the case was abandoned and I will not get my access payment of R3250 reimbursed. It might make no financial sense for Momentum but what about the financial sense for the client ? Will Momentum possibly recover the R12,000 by increasing my insurance premium ? Bottom line: the smarter lawyer wins irrespective of who is at fault ? Really, is this the modus operandi of all South African insurance companies ?

Almost ONE month later I am still waiting for "contact me shortly".
What made matters worse is that first I get a reply that the 3rd party insurance is "evasive", the I get a reply that it makes no financial sense for Momentum to litigate because the costs for that would be almost identical for the repair costs (paid my Momentum) - but what about my cost of R3250 for access. Then I get an email that the 3rd party has NO insurance !! The fact is that the 3rd party had insurance at the time of the accident (Feb 2019 !) but was running into financial difficulties due to Covid-19 and cancelled his car insurance. This is what the 3rd party told me on the phone.
Where does this leave me ? i assume that Momentum or Alex Forbes (at the time) didn't do anything for about one year after the accident. If the 3rd party had no insurance at the time - why was I not informed straight away instead of initially advising me that the 3rd party is "evasive".
