We were contacted by Mobius for a data contract for R99. The first month there came a huge surprise with an amount of over R800 due to going over the amount of data. Not very happy with this I wanted to cancel the contract, but was informed that the amount payable was astronomical. We decided to wait out the length of the contract, that was 13 July 2018, and we contacted them telephonicly in May 2018 already to find out what the correct procedure would be if we did not wish to carry on with the contract once the contract end date was reached. We were advise by the staff that we had to contact them in writing a month before the contract end to advise them of the decision. We put in writing our wish, and send it via email on 6 June 2018. I received a mail from Claudette, that advised us that there would be a fee of around R200 to cancel the contract. After several emails explaining we did not wish to cancel the contract prior the end date, only wished to not renew the contract once the contract end, we were advised that we need to contact them once the contract ended. We even did that, just to receive a phone call advising us that we were in arrears with the contract as the debit order did not go through on 1 August. On phoning their customer service department again, I again send a mail to Claudette, asking why I need to pay for something that already expired. The mails were send through to Jacqueline. I had to point out to her on their own terms and conditions the steps that had to be taken not to renew a contract as well as that you pay in advance for your service. Pointing out to her the several emails send to Claudette well before the end of the contract wishing not to carry on with the contract se came back to me to, saying: " Hi Lyon, Hope you are well this morning. Please be advised that the amounts will be debited from your account unfortunately you are liable to pay the amount outstanding. We do apologise for any inconvenience caused. Hope you have a lovely day further." How do they still want to debit my account if they did not follow their own terms and conditions and either not having or not following policies and procedures. This matter will be taken to ICASA and the Ombudsman.
