No contract just Transcripts and struggling with audio voice record contract

<p>I was called by Mobile Talk on 10 November 2014. They explained of the new LTE service that I can use that it can give me 90MB/s. My system actually never got to more than 20MB/s. The sales person said it would be R439/month. It was never mentioned that the contract would go on for 36 months. So since this was a Telkom contract I thought it would be a 24 months contract as 36 month contracts were not common for any mobile network. On 19 November 2014 it was confirmed that the service is activated. I asked with an email to ********** whether the contract is a month to month or a fixed term contract, no one has rep**** to that email to this day. When I saw that the 10GB did not last for more than 2 weeks and it is at a slower speed than the 90MB/s spoken by the salesperson, I got an uncapped ADSL line. It was slower than the 20MB/s I was getting with my LTE router but it was stable and didn&rsquo;t have the setbacks of air networks. I asked Telkom to cancel this contract multiple times via Telkom and they just gave me reference numbers and nothing happened for months. It was when they called me about an upgrade when I told the guy that I am not interested in an upgrade and in fact want to cancel the LTE contract. The guy from Telkom said I have 2 months left on the contract, I should rather wait for the next month so I can terminate the contract with correct procedure. I agreed. I filled in cancellation forms and was given reference number for it. No debits were taken for 2 months so I broke the sim card knowing that the contract is over. Next thing I was debited again. I call Telkom about my cancellation. When they came back to me about the cancellation they made me aware that the contract was a 3 year contract which I had to pay penalties for. I didn&rsquo;t understand because I thought I had a month left during that year. I realised I had been ****** a year. The lady further said that I had to wait for a call as they would need to communicate this to Mobile Talk to find out what type of contract that was. No one called me back. I just decided to call Mobile Talk directly because they might have the answer on this problem. Mobile Talk tells me that they didn&rsquo;t get any indication that I wanted to cancel the contract and wanted to find out whether the contract is 24/36 months via the audio records. Here I realised something was wrong. This year I started to request my contract from Mobile Talk so that I can actually see the clauses that explain how to terminate my contract so that I can do this cancellation by the book. I realised no such contract was given to me for this service. I asked for the contract, Annelyn sent me the product details of the contract and not the contract. After emailing back and forth Annelyn said &ldquo;Kindly be advised this was done over a telephonic sale and no contract was made. I further asked for transcripts I was given a very vague summary of what was said which didn&rsquo;t make sense to me. ***. When I was asking for more comprehensive transcripts, I was informed that the query was closed. (***)I asked for a Voice recording because it is tying me to a contract where the terms were not explained to me directly. I asked for voice recordings they proceeded to give me a bigger transcript which I didn&rsquo;t ask for. This transcript shows that I personally was not told of the duration of the contract that debits my account. It further proves that the &ldquo;Agent didn&rsquo;t obtain debit authorization&rdquo;. I got debited by Telkom from the beginning and only left it because I thought the contract was for the normal 24 months. When I take the conversation towards getting the voice recordings as I asked Annelyn told me it is against policy to release the voice records directly to me. She said I must go to a Telkom store and request the call recordings. Vigaren asked me to give him the store that I will be visiting so that he can arrange for the call recordings to be se I said he must send it to Kolonnade mall, he said &ldquo;no problem, will send below arranged by close of business&rdquo;. I went to the Kolonnade shop the next day to fetch the voice recordings as planned; no one knew what I was talking about. I left my email address with the guys at Telkom so that if there is anything from Mobile Talk they can inform or send it to me. I sent a mail indicating that I was currently at a store awaiting the voice records. An hour and a half later, I get an email from Vigaren that states I should ask for an alternative email to send to. This is an hour after I left the shop. The agents are playing games with my time. I want those voice records as I believe I was not fully informed by the Mobile Talk agent about the contract to finalize the contract properly. She also mixed my profile up with my wife&rsquo;s profile, causing problems with calling the call centre.</p>
