Failure to reply to email and change debit amount

After clarifying with an agent that Mobicred decides on a consumers behalf that they will automatically lower your debit order, despite an initial agreement of a 12month contract. I have since rep**** to the agent and yet to receive a response of the adjusted debit order. Mobicred are a complete *******.

Thank you for your review.

Please be advised, your mobicred facility is a revolving credit which means your instalments will decrease with every payment being that there are no other purchases. Your monthly instalment will always amount to 10% of your outstanding balance plus our service fee with an option for you to make additional payments. 

The pre-agreement received and signed advised that the 12 month repayment period was an estimation of cost to your interest and fees due.

We do apologise for this confusion.

Thank you once again for the standard response,

Similar to your consultants response "You are correct in saying that the Pre-Agreement you accepted when you opened the account indicated a 12 month repayment period. The mobicred credit facility is in fact a revolving facility, much like a credit card. A credit limit is approved, and you can choose to spend up to that limit by making one, or many purchases.

The National Credit Act defines a revolving product like mobicred as a “Credit Facility†, and as such, we are regulated as to how we must display the pricing when producing a Pre-Agreement. Below is an excerpt from the act, outlining the elements that a Pre-Agreement for a Credit Facility must contain:

(4) The following definitions will apply to Form 20, in respect of credit facilities that meet the criteria for small agreements:

(a) Credit advanced must reflect the total value of the credit facility;

(b) Instalment must reflect the minimum instalment required per the agreement, on the assumption that the total amount of the facility is utilized on the first day of the agreement; and

(c) Total of all instalments must reflect the total of all instalments plus the full repayment of the facility at the end of 12 months or at the end of the term of the agreement, whichever is the earliest.

Therefore we are required by law to specify the credit agreement as above, using 12 months to give an indicative repayment amount.

In reality however, you are only required to pay 10% of your outstanding balance each month. So if you only purchase once, your repayments will reduce each month as you lower the balance. That is why you have noticed decreasing debit orders on your bank statement.

You are also able to pay into the account at any time to further reduce the balance or shorten the repayment period.

We do have the facility to fix your monthly instalment if you so choose. However if you purchase using the account again, it will revert to the standard 10% repayment.

Please let us know if you would like to make any changes to your debit order, or if we can assist in any way. We are very sorry that the NCA regulations we are compelled by have created confusion."

As requested, I have asked to fix my monthly instalments due to this ridiculous policy, however, I've since not had a response, or acknowledgement to make these changes.
