MIX Telematics - Breach of contract
<p>I have 2 vehicles each fitted with Matrix Mix Telematix MX2 vehicle tracking units. At the time of purchase it appealed to me that the units comes with automated GEOLOC feature which is activated by a Driver Identification Device (DID) that the driver carries with him and that made my decision to puchase this particulat tracking system. When the driver is not close to the vehicle and the vehicle is moved then it would immediately give out an alert to Matrix indicating that a possible theft is in progress and I would receive an alert.</p> <p>I received an email from Matrix on 3/11/2016 informing me that the DID is now obslete and that in future to protect my vehicles with GEOLOC the driver must install an App on their celphone and each time you leave the car you must activate the GEOLOC through the App and when you return you must deactivate again through the App, i.e. no automatic activation and deactivation.</p> <p>If I let another member of the family drive the car then they too must download the App and if you do not have a smartphone or you forget to activate or deactivate then that is your problem, no automated GEOLOC protection! Not to mention the confusion that arise when the driver changes and the GEOLOC is activated or deactivated from different phones (I know because we did try to use the App).</p> <p>This is breach of contract and I expect Mix Telematics to provide me with an automated system that works in the manner as described when I entered into the contract with them at the original purchase.</p>

The Driver Identification Device (DID) hardware technology previously used by MiX Telematics has become obsolete. MiX Telematics continually strives to ensure that the latest technology is incorporated into our existing products and in a number of instances, the benefits of these new technologies are provided to existing customers.
The decision to migrate the functionality to the smartphone was made to ensure that the customer is no longer dependant on a battery powered additional device that needs to be carried and maintained.
The new mechanism allows the functionality to be used by any smartphone and also includes a SMS functionality in the event that the customer prefers not to use the smartphone.
The rate at which technology changes, impacts how functionalities are delivered to our customers. In addition to Matrix Early Warning, the customer now has access to a host of other features in the Matrix Smartphone App including the easy management of the movement of a vehicle. Most of this functionality did not exist previously and is provided to the customer at no additional charge.

I appreciate that MIX Telematics is trying to put a positive spin to their response however the bottom line is that the GEOLOC facility was supposed to be automatic and I now have to activate and deactivate it via my smartphone and each additional driver must also load it onto their phones. I was quite happy with the facilities that was previously available on the Internet Website and the Smartphone App does not make-up for the loss of value. In the end I have lost value and this remains Breach of Contract.
