VW McCarthy Gezina sold me a WRITTEN -OFF car, advertised as Demo.

In or around June 2018, I purchase a Kia Rio V 1.4 LX Hatch 5 Door.

When the car was marketed by the dealership, it was being sold as a demo model with no accident history with just over 7000 kilometres having been measured on the odometer. I also note that the car was marketed with a full-service warranty of up to 60 000 kilometres. The sale of the vehicle was executed on the basis of a deposit and monthly instalments. I paid for the deposit and the balance of the purchase price is being settled by means of monthly instalments.

On 21 November 2018, I took the vehicle in for the 15 000-kilometre servicing at Kia Motors, Menlyn. As a result of the inspection of the vehicle, I was informed that the warranty on the vehicle had been blocked as a result of the vehicle having been written off/s****ped. Kia Motors, South Africa confirmed that the vehicle had indeed been written off.

On 23 November 2018 I contacted and visited VW McCarthy Gezina dealership to inform them of the information that I had received from Kia Motors. The Manager of VW McCarthy, Mxolisi, advised that an investigation would be conducted regarding my query to determine why the vehicle was written off. This investigation was due to be completed within 7 days of my query. Mxolisi further advised that if the outcome of the investigation were to be that the car was in fact written off then a substitution of goods would be made. As a result of the investigation, the vehicle was retained by the dealership and I was given a temporary vehicle for use during the period of investigation.

It has been about 5 months since the investigation started and I am no closer to reaching finalisation of this matter. I am still, to this day, paying my monthly instalments on the Kia Rio I purchased from the dealership. I was promised a turnaround time of 7 days which was not realised and continue to be prejudiced as a result. To date, I have received no feedback regarding the investigation and i am still paying my monthly instalments, while the dealership is failing to sort out this issue.

With the above facts being noted, I state that I have been misled by the false and deceptive marketing of the dealership. As a result of the false and/or deceptive and/or misleading conduct, being the omission of a material fact, I was induced into purchasing the vehicle and incurring debts and liabilities thereof. I state without reservation that had such material fact been disclosed to me, I would not have purchased the vehicle from the dealership.
