Sold an Audi Q5 with defects-McCarthy VW Constantia

<p>I have major concerns and would like you to be able to assist in the matter as I am yet to get a formal response from your franchise dealership – <span style="text-decoration: underline;"><strong>McCarthy VW Constantia</strong></span></p> <p> </p> <p> In February 2017 (4 months ago) I purchased an Audi Q5 2.0T FSI for from McCarthy VW Constantia.</p> <p>It now has gear problem, cannot reverse once it starts having its episodes, I took it in to be fixed for the gear problem a month ago, fetched it on the 24th of June, and alomost got into an accident with it on the 28th of June because it started halting , beeping and showing "gear malfuntion signs" whilst I was driving mid peak traffic on Grayston drive, Sandton! </p> <p> </p> <p>To say I am disappointed about the shambles I have been through with your brand would be an understatement. I specifically bought my Audi Q5 from McCarthy VW as I thought it was a good brand and would be offered safe & quality vehicles and good service but my experience has been the opposite and biggest mistake I have done.</p> <p> </p> <p>I shudder at some of the verbal responses I received from your representatives; first I was told that I had no recourse and could not return the car and cant cancel bank financing contract (something that is a lie and is misleading; luckily being a Chartered Accountant and having worked as an Auditor before I understand the law and the branding your company wants to position itself in I feel sorry for consumers who don’t know their legal rights as they can fall for such.</p> <p>Just yesterday when my husband, was trying to resolve an issue with your sales executive and he expressed that I am returning the car and don’t want it fixed as it was fixed before when I brought it in last month , he was told the car will be assessed and fixed AGAIN and that we can’t just return the car or else we must just head to the ombudsman.</p> <p>I understand the pressure of your 30 June year end but I don’t take kindly to such threat. How dare they say go to the ombuddsman, they clearly are telling us to f-off (Is this how you treat your customers?)</p> <p> </p> <p>Just to summarize</p> <p> </p> <p>1. In February 2017 I purchased an Audi Q5 2.0T FSI from McCarthy VW Constantia.</p> <p>2. In April 2017, the electronic screen on the car reflecting car info stopped working . I was advised to bring the car in on the 13th April 2017. I brought it in and it was fixed.</p> <p>3. Because I was on maternity leave, I rarely drove the car. In May 2017 I resumed work and was now fully utilizing the car.</p> <p>4. On the 2nd day of resuming work I started getting notifications on the car screen that there is a “Gear Malfunction” also stated that something along the lines that “Gear in reverse mode” and that was when I was driving straight ahead. Not only that, it also “TPMS” and some other signs- which I have attached.</p> <p>I got in touch with Dylan H (manager at that time whom I heard has since left), and he advised I bring it in to be looked at.</p> <p>5. After much follow up on the car from my side , as well as trying to get in touch with you (that’s when I spoke to your PA who took my numbers and said she would be intouch with Tienie Stoffberg) I finally got a call from Tienie Stoffberg</p> <p>6. Car was taken to GearTronix to get fixed for the megatronic issue (something I felt uncomfortable about as I felt it should have been fixed at Audi) and I made this known to your dealership</p> <p>7. I was advised to come fetch the car, which I did this past Saturday; 24 June 2017 with my husband Dr. Gideon Fareo</p> <p>8. Yesterday; 28 June 2017 (4 days after I fetched the car)- I almost got into an accident with the car, as it started slowing down (as if losing power/not in gear struggle) whilst I was driving in high peak traffic on Grayston drive, Sandton -on my way to work.</p> <p>9. Similar signs and notifications as the previous time of “Gear Malfunction” TPMS” Reverse mode gear” and engine sign and a beeping sound came about(I have a video to prove this, which I have sent to your used-sales executive Gareth )</p> <p>10. I managed to get to my place of work and as I was trying to park I realized that the car couldn’t enter reverse mode. The car could not reverse. (I have a video to prove this, which I have sent to your used-sales executive Gareth )</p> <p>11. The car is clearly unroadworthy- it starts halting when one is driving in full gear and the instance where it was not entering reverse mode.</p> <p>12. I have 2 babies ; a 5 month old and 2 year old that I want to raise, and wouldn’t want to put their lives or my life in danger. Mr Vermaak I want to raise my children like any parent does. What if all this happened when they were in the car? What if this happened during the night while I was somewhere alone? What if the car behind me did not stop in time? We would be speaking another story.</p> <p>13. On the 29th of June 2017 the car was towed from my office.</p> <p>14. I cannot keep this car, I refuse to keep such a car with defects that are clearly unfixable as I had sent it in before to be fixed and was assured everything was in tip top shape; was even given a report from Audi who did a full assessment.</p> <p>15. Per section 56 of the consumer protection act- I have a right to return the car (please refer to below email).</p> <p>16. I have the videos with me and can send them to you on request.</p>
