refusing to fully refund the money I paid for a car they failed to get.

I was contacted by a sales person Stephan Kruger at Mccarthy Audi menlyn.

He called me on the 14th of March and offered me a vehicle. I clearly specified that I was looking for a white s3 sedan. I gave him all the specs and he told me you had the exact car. I told him I had been looking for certain specs, and I was not prepaid to compromise. He immediately sent me a quote(wrong quote! a hatch instead of a sedan) with the specs. I told him I will be paying cash for the car, and as such I will make a upfront payment. I sent him a whats up message the same night…"Just to confirm that I want an S3 sedan. Exactly the specs you gave me. Not a sports back.” That is what I wrote and your reply was…” Ok have the sedan like that will change the car then” That reply was sent to me 6:44 pm.

The following day by 4:49 pm I sent him a whats up “Please send me a quote as promised”.

He then sent me a whats up message and voice mail saying he had a white sedan that is docking in Cape Town the same week but he could not send me an invoice because he did not have a vin number. On that voice mail he specified a lot of extra’s which are clearly not on the quote that he subsequently sent. I told him I wanted a refund.. and he rep**** that if I wanted a refund he will do so the following day. Voice messages were sent to me at 5:02Pm.

By the 23rd of March he had not sent me the quotation. He sent me computer screens which he said indicated that the Audi system was offline.

On the 27th of March he sent me a quote on a nano Grey car. I responded that I told him I did not want any other colour except white.

He then, sent me a quote on the same car I had rejected from Sandton Audi. He said: “I bought the car from Durban for you and it took me 2 weeks and i traded them 2 cars to get the car. can i send you the froof of paymint that i paid for the car” This is exactly what he typed with all the spelling errors as the message came through to my whats up app at 02:04 pm, Wednesday 29th of March 2017. I told him I am not sure of the car. I had rejected it before from another dealer.

This is not a judge of character. I do not know him from a bar of soap. He **** on numerous occasions, just so that he can sell a car. At the onset he said you had an s3 sedan, white with all the specs I wanted. He actually never had one. He kept on sending wrong quotes. This is not what I expect from a competent sale person. He **** again by telling me he was expecting a car to dock in Cape Town. That never materialised. You then came up with a story of having purchased the car from Durban. On the 30th of March 2017 he sent me pictures of the same car I didn’t accept. This pictures were taken in February 2017, and the car was from Fourways Audi.

In summary,

I have never driven an Audi and with sales people like you I will never drive one. You can kiss this deal goodbye. If I was not a serious buyer, I would not have transferred R208000 into Menyln Audi. In fact, Audi owes me an apology for wasting my time and subjecting me to lies and incompetence.

Audi SA has failed to assist in this matter. Mccarthy Audi wants to deduct 10% of the cost of the car! That is outrageous and *******. Certainly not in keeping with the consumer protection act.

In my experience, you get a quote, which a client signs and accepts with the conditions outlined. So, if you tell me you are taking 10% of the money I transfer, do you even know how much it is? I wonder, but be the judge. I rest my case.
