Refuse to repair under Motor Plan

<p>On or about 24/03/2015 I purchased a new (extended) maintenance plan on my jeep by completing the “Motor Vehicle Protection – Extended Maintenance Contract Certificate, a copy which is attached hereto marked as Annexure “A1”. This plan refers to certain documentation which the salespeople never supp****. The salesman indicated that he would send it to me as soon as possible which he failed to do. I therefore re**** on the verbal information of coverage as described below.</p> <p>At the time of concluding the agreement, I was informed by the sales person and / or Mrs Daleen Wright, a registered credit agent for Bidvest McCarthy, Brooklyn Branch, that the said new maintenance plan was comprehensive in that it covered all repairs including, inter alia, electrical repairs.</p> <p>On 21 February 2017, I sent my Jeep in for repairs at Chrysler, Jeep, Wrangler in Montana. On 24 February 2017 I was informed via email by Mojela Katlego that the required repairs were not covered by my new maintenance plan. Following several e-mail messages over a period of time he further provided me with an unsigned list of repairs that were not covered by my maintenance plan, however the list was never part of the agreement with Mrs Daleen Wright or any sales person and to which I never consented as they assured me on numerous occasions that the maintenance plan covered everything apart from things as tires, oil (consumables) and the windows and body work / painting.</p> <p>Again on 28 February 2017 I requested that they furnish the relevant part of the contract I signed which excludes the electrical air conditioner switch from being repaired under the motorplan, however they only provided me with a general, unsigned terms and conditions that were not part of the agreement.</p> <p>On the instruction of Mojela Katlego I proceeded to email Mr Stuart Mofatt on 7 March 2017 with my queries and requested that he respond urgently as my maintenance plan was due to expire on 23/03/2017. However, I only received a reply from Mr Mofatt on the 14th of March. Mr Mofatt stated that he was unable to locate the contract with that was signed but that he could only find the contract that I was already in possession of, in which no mention is made of the terms and conditions that excluded the required repairs. I am still waiting for Jeep to supply me with a copy of the contract I signed where I agreed that the said repairs are excluded from the maintenance plan.</p> <p>I sent several e-mail messages to Mr Mofatt requesting him for the agreement and warning him of the impending laps of the motor plan. Mr Mofatt simply stated that the Jeep will not be repaired if the motor plan lapses. Clearly Jeep is the cause of repairs not being doen prior to the laps of the motor plan. On +/-23 March 2017 and as a result of the conduct of Bidvest McCarthy, my Jeep’s maintenance plan had lapsed without any repairs being affected, despite my Jeep being with the dealer for over a month.</p>
