BURCHMORES DURBAN RIPP OFF CODE 2 SOLD AS FUNCTIONAL VEHICLE

On the 14th March 2019, I purchased a VW,2014 Polo at an auction at Burchmores. I took possession of the car later that day along with the LogbookThe car had minor scratches which were visible. There were no remarks or notes about the condition of the vehicle .I drove the car out went to the garage as I was told to start there hence it may need water and petrol,I went straight to the garage.first problem we couldnt open the bonnet,I went back to them where the mechanic assisted me to open as he had to use a pressure to open it. When I was driving the car there was a sound which I assumed it was the spare wheel moving.

I then took the took the car to a panel beater to assist me with dents and repaint. I left the car with the mechanic on Saturday the 23 March ,the car was parked all along hence I was not in town. He opened the bonnet foud the engen fastened with rope, steering wheel showing the airbag burst and confirmed the car was involved in an accident, at the back the boot could not open without support., the doors were not lockable. It proved the car was in a major accident but nothing was mentioned. I paid R7000 thinking it was for repaint and sent while the total was gonna be 13000. The panel beater said the car is gonna cost me nearly the price I bought with. Also as u drive the engen moves hence it seems it was in a head on collision by drivers side. I cant pay this much knowing I bought a car that I was not told that it was in an accident.

The car was sold under false pretence.i bought the car to travel to work with and I am suppose to travel as from the 1st using the car. I require a refund for this ********** purchase at least if I knew like SMD ,they tell you that the car is damaged and you buy the car aware. Secondly Burchnores has a policy that the car is sold as is and will not entertain any fault after the sale.

According to Consumer Protection Act, auctioneers are prohibited from knowingly misinterpreting the value,composition, structure,character of goods they put up for sale in auction.

Burchmores is guilty of such as the subsidiaries of Bidvest McCarthy I am positive they are aware of such act and they were aware of the condition of the vehicle hence it was in their position. The ropes are visible. I require a refund .I was sold the car under pretence that the car is functional and I a good condition. On auction you cant even test drive the car. I need my refund, and return the car as breach on consumer act as the car was sold on false pretence
