BURCHMORE's CAR NIGHTMARE

So on the 7 April 2018 I purchased a 2013 BMW 320D for R140 875.00 inc vat. at the auction. i received the car on the 10 April 2017, exactly 7 days ago. From the minute i drove the car out of the warehouse i noticed a very bad vibration on the drive-train of the vehicle. Now when i purchased the vehicle no comments was made on the fault, nor on the Auction Catalogue "remarks" section of any of the cars being auctioned. Now Burchmore's makes it very clear that "Burchmore's will not entertain any FAULTS, MECHANICAL or OTHERWISE AFTER THE SALE" and "NO DUTY TO REPAIR".

So i decided to have the fault checked at a suspension shop and got told it is the engine mounts and would cost R5304.95, i decided to have this repaired, but to my horror this did not fix the problem but merely reduce the problem slightly. I then took it to a bmw afilliated workshop to check if they can resolve the problem. I had to pay them R517.50 to troubleshoot the problem and they found that the problem is the clutch and flywheel and it will cost R12880.00 to repair. Now I havent done this repair as im actually terrified that if i paid this expense and it doesnt fix the problem, the total repair cost would be R18702.45 since purchasing this damaged car from BIDVEST BURCHMORE'S.

For the 7 days that i have owned this car it has spent more time in repair shops than me enjoying it. As BIDVEST BURCHMORE'S is a subsidiary of BIDVEST McCarthy, surely McCarthy would also have noticed this problem on the car if they have been in possession of this vehicle.

"According to the Consumer Protection Act, an auctioneer is prohibited from knowingly misrepresenting the value, composition, structure, character, quality or manufacture of the goods put up for sale at an auction. " and this is exactly what BIDVEST BUCHMORE'S is guilty of, by not mentioning the fault at the auction or in their vehicle catalogue list. Atleast at a SMD auction everyone is made aware of the fact that the cars are damaged and needs to be repaired so the cost of the vehicles takes this into account, but BURCHMORE's sold me this car under the pretext that it is fully functional, yet it is a damaged and a unsellable vehicle at any dealer, but easily sellable at a auction, due to not being able to test drive the vehicle.

I would really like to think that good deals can be made at attending a auction, but if this car of mine cannot be returned due to them breaching the Consumer Protector Act then they should be classified as just another SMD auction, hiding behind a large company name like "BIDVEST" to lure their victims in for a quick buck.

All i wanted was a nice family car, but what i got was a train wreck of a car making me spend more time in repair centres that uses trial and error methods at my expense to try and fix a reject car acquired from BURCHMORE'S whether they know what the exact fault is or NOT it has become the victim's problem to resolve and i am disgusted that a situation can even occur in this day and age.

I would like this car to be returned and be refunded as it was purchased under the intention that it had no faults, and the fault only emerged when the vehicle was driven, conveniently for them, or has this ultimately been the intention of this auction?

Burchmore's has refunded me for the vehicle i purchased and also paid for the cost of the engine mounts that i had done on the vehicle. Thank you McCarthy Customer Care for assisting.
